DĖL NEPRITARIMO ABORTŲ DRAUDIMUI LIETUVOS RESPUBLIKOJE

Mes griežtai nepritariame ketinimams drausti atlikti abortus Lietuvos Respublikoje ir esame įsitikinę, kad:

- nėštumo nutraukimo draudimas yra neleistinas įsikišimas į žmogaus teisę į privatų gyvenimą, kurią saugo ne tik Lietuvos Respublikos Konstitucija, bet ir Europos žmogaus teisių ir pagrindinių laisvių apsaugos konvencija;
- nėštumo nutraukimo draudimas reiškia netoleruotiną moters teisių ir laisvių suvaržymą;
- draudimai nelems mažesnio nėštumo nutraukimo skaičiaus, o tik padidins neteisėtų nėštumo nutraukimų skaičių, kurie dažnai gali būti pavojingi moters gyvybei;
- nėštumo nutraukimo draudimas lems nėštumo nutraukimo paslaugų „turizmo“ sektoriaus išaugimą;
- Lietuvos Respublika turi būti ištikima jos piliečiams ir užtikrinti jų teises ir laisves, bet nesiremti išimtinai vienos religijos primetamomis taisyklėmis – pagal Lietuvos Respublikos Konstitucijos 43 straipsnį Lietuvoje nėra valstybinės religijos, taigi katalikybės dogmos negali būti įstatymo projekto aiškinamojo rašto pagrindinėmis eilutėmis;
- priemonė mažinti nėštumo nutraukimų skaičių Lietuvoje yra asmenų švietimas, tačiau ne draudimai, atimantys bet kokią sprendimo teisę.

Mes, reaguodami į tai, kad:
1) Lietuvos Respublikos Seimas 2013 m. gegužės 28 d. po pateikimo pritarė Gyvybės prenatalinėje fazėje apsaugos įstatymo projektui (registracijos Seime Nr. XIIP-337), iš esmės draudžiančiam abortus Lietuvoje („už“ balsavo 46 Seimo nariai, „prieš“ – 19, susilaikė – 25),
2) Lietuvos Respublikos Seimo Sveikatos reikalų komitetas 2013 m. gruodžio 11 d. iš esmės pritarė Gyvybės prenatalinėje fazėje apsaugos įstatymo projektui (registracijos Seime Nr. XIIP-337), iš esmės draudžiančiam abortus Lietuvoje („už“ balsavo 6 Sveikatos reikalų komiteto nariai; „prieš“ – 2; susilaikė – 1),

išreiškiame griežtą ir nedviprasmišką nepritarimą bet kokioms teisėkūros iniciatyvoms, draudžiančioms abortus Lietuvos Respublikoje, ir raginame Lietuvos Respublikos Seimo narius, neabejingus žmogaus teisių ir laisvių užtikrinimui, balsuoti prieš bet kokias iniciatyvas, draudžiančias nėštumo nutraukimą Lietuvoje.


PETITION CONCERNING OPPOSITION TO THE TERMINATION OF ABORTIONS IN LITHUANIAN REPUBLIC

We strictly disagree with intentions to ban abortions in Lithuanian Republic. We are sure that:

- prohibition of the termination of pregnancy is inadmissible intervention to a human right to a private life which is protected not only by the Constitution of Lithuania but also by the European Convention on Human Right;
- prohibition of the termination of pregnancy means an intolerable women’ rights and freedoms’ restriction;
- in general, prohibitions are not going to determine to a smaller number of the termination of pregnancy but it will only increase illegal terminations of pregnancies which often can be dangerous to a woman’s life;
- prohibition of the termination of pregnancy will determine the growth of the tourism sector of the termination of pregnancy services;
- Lithuania must be loyal to its citizens as well as ensure their rights and freedoms but do not refer exclusively to only one religion’s imposed rules. According to the Constitution of Lithuania 43 article there is no national religion in Lithuania so Catholicism dogmas cannot be the main lines of law project’s explanatory note;
- a measure to diminish the termination of pregnancy in Lithuania is persons’ education but not prohibitions that take away the right of decision.

In response to the initiatives that:
1) On 28th of May, 2013 after a presentation the Seimas of Lithuanian Republic approved the project of prenatal phase of Life which in principle bans abortions in Lithuania (there were 46 votes “for”, 19 “against” and 25 members of Seimas abstained),
2) On 11th of December, 2013 Lithuanian Parliament Health Committee approved the project of prenatal phase of Life which basically bans abortions in Lithuania (there were 6 members of the Committee of Health Affairs that voted “for”, 2 “against” and just one who abstained),

We express our strict and unequivocal objection to any lawmaking initiatives that prohibit abortions in Lithuanian Republic. Moreover, we encourage all members of the Seimas of Lithuanian Republic who are partial to human rights’ and freedoms’ assurance to vote against any initiatives that prohibit the termination of pregnancy in Lithuania.
